INSURANCE & LICENSING

Insurance Coverage

ATP Landscape and More is fully licensed and insured to operate as a commercial motor carrier in the State of Georgia. Our insurance coverage includes:

• Commercial Auto Liability Insurance: Meets or exceeds Georgia state requirements for commercial motor carriers
• General Liability Insurance: Protects against property damage and bodily injury claims
• Worker's Compensation: Covers all employees and operators

Licensing & Compliance

• Licensed by the Georgia Department of Transportation
• USDOT registered carrier for intrastate commerce
• All vehicles meet FMCSA safety standards
• Regular vehicle inspections and maintenance performed
• All operators possess valid commercial driver's licenses (CDL) where required

TERMS OF SERVICE

1. Acceptance of Terms

By requesting, scheduling, or using any services provided by ATP Landscape and More ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Services Provided

ATP Landscape and More provides the following services within the State of Georgia:

• Dump truck hauling services (up to 20-ton capacity)
• Dumpster rental and delivery (20-yard and 30-yard containers)
• Material handling and transport
• Debris removal services
• Construction site support

3. Service Requests & Scheduling

• All service requests must be submitted via phone, email, or our online request form
• Service dates are subject to availability and weather conditions
• We will confirm all bookings within 24 hours of request
• Changes to scheduled services must be made at least 24 hours in advance
• Same-day service requests are accommodated when possible but not guaranteed

4. Pricing & Payment

• Pricing varies based on service type, duration, materials, and location
• Final pricing will be confirmed before service commencement
• Payment options include: per load, hourly rate, daily rate, or flat rate
• Payment is due upon completion of service unless otherwise arranged
• Accepted payment methods: cash, check, credit card, or invoice (for approved commercial accounts)
• Late payments may incur additional fees
• Prices do not include disposal fees, which vary by material type

DUMP TRUCK SERVICES - SPECIFIC TERMS

Service Scope

• Maximum load capacity: 20 tons per truck
• Customer is responsible for ensuring materials do not exceed weight limits
• Overweight loads may result in additional charges or refusal of service
• We reserve the right to refuse hauling of hazardous materials

Loading & Unloading

• Customer is responsible for proper loading unless otherwise arranged
• Loading must be completed in a safe and timely manner
• Customer must ensure clear and safe access for truck entry and exit
• Delays caused by improper site access may result in additional charges

Materials

• Customer must accurately describe materials to be hauled
• Prohibited materials: hazardous waste, chemicals, asbestos, medical waste, explosives
• We reserve the right to refuse service if materials differ from description
• Additional charges apply for mixed loads requiring special handling

DUMPSTER RENTAL - SPECIFIC TERMS

Rental Period

• Rental rates based on per-load or per-day basis as agreed
• Rental period begins upon delivery and ends upon pickup
• Extensions available upon request (additional charges apply)
• Customer must notify us when dumpster is ready for pickup

Placement & Site Requirements

• Customer must designate a safe, accessible location for dumpster placement
• Site must have adequate clearance for delivery truck (minimum 14 feet height, 10 feet width)
• Customer is responsible for obtaining any necessary permits
• Dumpsters placed on public property require permits (customer's responsibility)
• We are not responsible for damage to lawns, driveways, or surfaces during placement/removal
• Customer may request protective boards/plywood (additional fee may apply)

Acceptable Materials

Materials must be properly separated by type. Pricing varies based on material:

• General Trash/Debris: Household items, furniture, construction debris (wood, drywall)
• Dirt/Fill Material: Clean dirt, soil, clay (must be free of debris)
• Concrete/Stone: Concrete, brick, block, asphalt (must be separate from other materials)

Prohibited Materials in Dumpsters

The following items are strictly prohibited and will result in additional fees or refusal of service:

• Hazardous waste (paint, chemicals, solvents, oil, gasoline)
• Asbestos or asbestos-containing materials
• Medical waste or biohazards
• Tires (unless pre-arranged)
• Appliances with freon (unless pre-arranged)
• Batteries (car, household, industrial)
• Propane tanks
• Electronics with CRT screens
• Railroad ties (unless pre-arranged)
• Dead animals

Weight & Fill Limits

• Dumpsters must not be filled above the top rim
• Overfilled dumpsters cannot be transported for safety reasons
• Weight limits apply based on dumpster size and material type
• Overweight dumpsters subject to additional tonnage fees
• We reserve the right to refuse pickup of overfilled or overweight dumpsters

LIABILITY & DISCLAIMERS

Customer Responsibilities

• Customer is responsible for ensuring safe site conditions
• Customer must identify and mark any underground utilities, septic systems, or irrigation lines
• Customer is responsible for proper material segregation
• Customer warrants they have legal right to dispose of all materials
• Customer is responsible for securing any required permits or permissions

Company Liability Limitations

• We are not responsible for damage to unmarked underground utilities
• We are not responsible for damage to driveways, lawns, or property surfaces caused by normal equipment operation
• We are not responsible for damage caused by customer's improper loading or overfilling
• We are not responsible for property damage caused by inadequate site access or conditions
• We are not responsible for delays caused by weather, road conditions, or circumstances beyond our control
• Our liability is limited to the cost of the specific service provided

Indemnification

Customer agrees to indemnify and hold harmless ATP Landscape and More, its owners, employees, and operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Customer's violation of these Terms of Service
• Customer's disposal of prohibited or improperly described materials
• Customer's failure to properly secure or maintain the rental dumpster
• Damage to third-party property caused by customer's actions
• Any illegal activity conducted by customer in connection with our services

CANCELLATION & REFUNDS

Cancellation Policy

• Cancellations must be made at least 24 hours before scheduled service
• Cancellations made less than 24 hours in advance may incur a cancellation fee
• No-shows or failure to provide site access will be charged full service fee
• Weather-related cancellations initiated by the Company will not incur fees

Refunds

• Refunds are issued at Company's discretion
• No refunds for services already rendered
• Partial refunds may be issued for canceled rental periods (prorated)
• Refund requests must be submitted in writing within 7 days of service

ADDITIONAL TERMS

Service Guarantee

We strive to provide professional, reliable service. However, we do not guarantee:

• Specific arrival times (we provide estimated windows)
• Same-day service availability
• Service during severe weather or unsafe conditions
• Ability to access all requested locations

Force Majeure

We are not liable for delays or failure to perform services due to circumstances beyond our control, including but not limited to: severe weather, natural disasters, road closures, equipment failure, labor disputes, or government restrictions.

Dispute Resolution

• Any disputes will be governed by the laws of the State of Georgia
• Disputes will be resolved in Forsyth County, Georgia
• Customer agrees to attempt good-faith negotiation before pursuing legal action
• Customer waives right to class action lawsuits

Modifications to Terms

ATP Landscape and More reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms of Service constitute the entire agreement between Customer and ATP Landscape and More regarding the use of our services, superseding any prior agreements or communications.
